Welcome to Brandacle. These Terms of Sale apply to all purchases made through our website [www.brandacle.com] (the "Site"), operated via Shopify. By purchasing digital products from Brandacle, you agree to the terms below.

 

1. Digital Products Only

All products sold on Brandacle are digital downloads (e.g., mockups, templates, or other design assets). No physical products will be shipped.

2. License & Usage Rights

When you purchase a mockup, you are granted a non-exclusive, non-transferable license to use the product for personal or commercial use in accordance with our license terms.

You may:

• Use mockups for client work, personal projects, and portfolio showcases, if the type of license you have bought allows it.

• Incorporate them into commercial designs (e.g., ads, product presentations), if the type of license you have bought allows it.

You may not:

• Resell, redistribute, sublicense, or share the original files.

• Claim the mockups as your own design.

• Use them in any way that competes with Brandacle (e.g., reselling on marketplaces).
  

Some mockups may feature recognizable buildings, public spaces, trademarks, or other visual elements photographed from public locations. Brandacle does not claim ownership or endorsement of any such properties. Architectural works, landmarks, and designs may be protected by copyright, design, or trademark laws in certain countries. These mockups are provided solely for design presentation and visualization purposes. Buyers are responsible for ensuring their final use complies with applicable intellectual property and publicity rights, especially in cases of commercial distribution or advertising use.

Certains mockups peuvent représenter des bâtiments, espaces publics, marques ou autres éléments visuels reconnaissables photographiés depuis des lieux accessibles au public. Brandacle ne revendique aucun droit de propriété ni aucune approbation de ces éléments. Les œuvres architecturales, monuments ou designs peuvent être protégés par le droit d'auteur, le droit des dessins et modèles ou le droit des marques dans certains pays. Ces mockups sont fournis uniquement à des fins de présentation et de visualisation de projets graphiques. L'utilisateur final reste responsable de vérifier la conformité de son utilisation avec la législation applicable, notamment en cas d'usage commercial ou publicitaire.

3. Payment

All payments are processed securely via Shopify's payment gateway. Prices are listed in USD unless otherwise stated. Taxes may apply based on your location.

4. Refund Policy

Due to the digital nature of our products, all sales are final. We do not offer refunds, exchanges, or cancellations once a file has been downloaded. If you experience any issues with your download or the file is corrupted, please contact us and we'll help resolve the issue.

5. Intellectual Property

All content, including but not limited to mockups, images, branding, and design elements, remain the intellectual property of Brandacle. Purchase does not transfer ownership.

Trademarks and Third-Party Brands

Brandacle’s products are high-resolution digital mockup photographs and composite files intended for use by graphic designers and creative professionals in client presentations, portfolio work, and design comping. Some of these images incidentally depict real-world public advertising spaces, street furniture, and urban infrastructure. Any third-party trademarks, logos, brand names, or trade dress that may appear in these images are the exclusive property of their respective owners. Brandacle is not affiliated with, endorsed by, sponsored by, or otherwise associated with any of these third parties, including but not limited to any operators of outdoor advertising networks, transit advertising, or interactive kiosk systems. Brandacle makes no claim of ownership over any third-party trademarks that may appear in its images and does not use any such trademarks to identify the source of its own products. The presence of any third-party trademark in an image is incidental to the depiction of the underlying public space and is not intended to suggest affiliation, endorsement, or sponsorship.

6. Updates & Availability

We may update products for quality or compatibility purposes. Purchasers may receive updated versions when available. However, we do not guarantee lifetime access to downloads.

7. Limitation of Liability

Brandacle shall not be held liable for any loss or damage arising from the use or misuse of our digital products. All files are provided "as is" without warranties of any kind.
